Terms of Use

Please read these terms very carefully as they form a binding Agreement between you and OCTOMAX PTE. LTD(“we”, “our”, “us”)regarding the use of our mobile app PlayQuest (“app” or “service”). .

YOUR USE OF THE APP CONSTITUTES YOUR ACCEPTANCE OF AND AGREEMENT TO BE BOUND BY THESE TERMS. If at any time you do not agree with any of these Terms, you must immediately stop using the app.

These Terms are subject to change by us, in our sole discretion, at any time, without prior notice. Any changes to these Terms will be in effect as of the "Last Updated Date" referenced in these Terms. By accessing, using, downloading, or logging into the app after the "Last Updated Date", you agree to the changes to these Terms.

1. Access and Use of the App

We grant you a limited, non-exclusive, non-transferable, and revocable license to use our app and service subject to these terms and the following restrictions in particular:

• Don't use our app to break the law. You agree that you will not violate any laws in connection with your use of the app. This includes any local, state, federal, and international laws that may apply to you or us. For example, you must not engage in fraud, theft, anti-competitive conduct, threatening conduct, or any other unlawful acts or crimes against us, our other users, or a third party.
• Don't try to harm our systems. You agree not to interfere with or try to disrupt our app, for example by distributing a virus or other harmful computer code into our app program or third party service. You agree not to use the app to engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the app or which, as determined by us, may harm us or expose us to liability. You agree that we reserve the right to audit our systems to ensure integrity and compliance with these Terms, at our sole discretion.
• Don't access or attempt to access or use the app or any portion thereof, through any automated means, including but not limited to the use of scripts or web crawlers.
• Don't attempt to do anything, or encourage, assist, or allow any third party to do anything in violation of these terms.

Without limiting other remedies, we may limit, suspend or terminate our services, prohibit access to our app, and take technical and legal steps to keep you off the app if we think that you are creating problems, causing possible legal liabilities, breaching these terms, or acting inconsistently with the letter or spirit of our policies.

2. Age Limitation

By using the app, you are confirming you are over the age of 13. You may not use the app if you do not have the legal capacity under applicable law to agree to these terms. We may require proof of age or we may require parental or legal guardian consent at any time. We also reserve the right to block users if we suspect they are under the applicable age.

3. Third-Party Services

Our app may contain links to third-party applications or services that we don't own or control (for example, links to Facebook). You may also need to use a product or service of one of our subcontractors or other third parties in order to use some of our Services (like a compatible mobile device to use our app). When you access these third-party applications or services, you do so at your own risk. The third parties may require you to accept their own terms of use. We are not a party to those agreements; they are solely between you and the third party. You agree that we will not be liable to you in any way for your use of these third party services.

4. Disclaimer

We are dedicated to making our app the best they can be, but we're not perfect and sometimes things can go wrong. You understand that our services are provided "as is," with all faults and without any kind of warranty (express or implied).

We do not guarantee that:

• The app will be secure or available at any particular time or location -we shall not be liable for any delays, interruptions or loss of data in connection with the use of our app and service.
• Any errors for which we are responsible will be corrected.
• The Services will always be free of viruses or other harmful materials.
• The results of using the app will meet your expectations.
• You use the app solely at your own risk.

5. Virtual Items

When you complete specific tasks within the App, you may earn points. If you violate this Agreement, we will clear the points in your account.
When your points reach a threshold, you will have the option to redeem them for Virtual Items(such as Game Point Cards, Promo Code). Points and Virtual Items cannot be exchanged into real money.
You agree that we have the right to adjust the tasks, points redemption rules, and Virtual Items at any time.
For the rules for using Virtual Items, please read the terms of use of the specific game store(such as GameStop, Steam).

6. Intellectual Property

Except as may otherwise be provided, the app and the content included in or made available through the app, such as text, graphics, logos, images, sounds, videos, digital downloads, data compilation, software, and documents, are our exclusive property and are protected by applicable intellectual property laws. All rights, title and interest not expressly granted with respect to the app and content provided on or made available through the app are reserved and retained by us.

7. General

No agency, partnership, joint venture, employee-employer, franchisor-franchisee relationship, etc. is intended or created by these terms.

We will not be liable or responsible to you, nor be deemed to have defaulted or breached these terms, for any failure or delay in our performance under these terms when such failure or delay is caused by or results from acts or circumstances beyond our reasonable control, such as any fire; flood; earthquake; governmental action; war, invasion or hostilities; national emergency; explosion; terrorist threat or act; riot or other civil unrest; insurrection; epidemic; lockout, strike or other labor dispute (whether or not relating to our workforce); inability or delay in obtaining supplies; telecommunication breakdown; or power outage.

If any provision of these terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced. Headings are for reference purposes only and do not limit the scope or extent of such section. Our failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches. We do not guarantee we will take action against all breaches of these terms.

We at our own discretion reserves the right to transfer or assign these terms or any right or obligation under these terms at any time.

We may terminate your right to use or access the app immediately and without notice for any reason whatsoever. Upon such termination, you agree to immediately cease accessing or using the app and agree not to access or make use of, or attempt to use, the app.
